D.C. Circuit Review – Reviewed: Slow Week
The D.C. Circuit issued only one opinion last week, and it wasn’t about administrative law. (The case involved a civil contempt motion to enforce an injunction that protected free-exercise rights under the Religious Freedom Restoration Act.)
The court did hear arguments on several administrative-law cases, including:
- Alphabet Workers Union-Communication Workers v. NLRB, which involves a labor dispute between Google and a union that represents YouTube contract workers (but may be decided on mootness grounds);
- Ange Samma v. DOD, which asks whether the Department of Defense has the statutory authority to require non-citizens who serve in the military to serve a minimum period of time before applying for citizenship (also may be decided on mootness grounds);
- Washington Lawyers’ Committee for Civil Rights v. DOJ, which asks whether the federal Bureau of Prisons is complying with the Freedom of Information Act; and
- Energy Harbor, LLC v. FERC, which involves a challenge to a penalty that the Federal Energy Regulatory Commission imposed on an electricity generator.
