Upcoming ABA Teleforum on Michigan v. EPA
The ABA Admin Law Section is hosting a teleforum on Michigan v. EPA this Thursday, July 16 at 11:00 AM. Details on the program are available here.
The program will feature Richard Revesz (NYU School of Law), Andrew Grossman (BakerHostetler), and yours truly. Adam White (Boyden Gray & Associates, Manhattan Institute) will moderate the discussion.
The program will debate whether Michigan v. EPA is likely to have ramifications for other rulemakings by the EPA and by other agencies. Panelists will debate whether lower courts are more likely to either: 1) read broadly the statements in both the majority opinion and the dissent concerning the need for agencies to consider costs, or 2) read the decision narrowly by focusing on statements that limit some of the reasoning to “the present context.” The discussion will also focus on the decision’s impact on cost-benefit jurisprudence.
